Close the Flavored Disposable Vape Loophole!
In 2020, the FDA released guidance banned flavored, cartridge-based vaping products, but it failed to ban flavored disposable vaping products. As a result, our children haven’t stopped vaping, they’ve just moved to using the disposables that manufacturers intentionally market in kid-friendly flavors like cotton candy and bubble gum.
So it shouldn’t surprise anyone that since the FDA policy went into effect, disposable e-cigarette usage among high school youths has spiked 2,188 percent (since 2019), according to the 2022 Centers for Disease Control and Prevention (CDC) National Youth Tobacco Survey. Nearly 2 million American middle and high school students still vape, with over 8 in 10 of them using flavored e-cigarettes.
If the Biden administration truly cares about stopping the youth smoking epidemic, its FDA will close the loophole on flavored disposable vaping products before it’s too late.
China is Exploiting the Disposable Vape Loophole!
While plenty of domestic manufacturers exploit this loophole and market their products to children, China is the worst of the bunch.
China is one of the world's largest producers of disposable vape products, which it makes in unregulated facilities. America’s health regulators have linked Chinese-made vape products to a recent spate of illnesses and deaths due to the fact that some have been found to be laced with fentanyl.
Given that fentanyl is a synthetic opioid that is 100 times more potent than morphine, the risk from these illicit vapes is unacceptable. Although two milligrams or less is often enough to kill a full-grown adult, smugglers have already brought enough illicitly manufactured fentanyl in from China to kill every man, woman, and child in America.
The 2020 Annual Report of the US-China Economic and Security Review Commission noted that, "China remains the primary source of illicit fentanyl and fentanyl-related substances that are trafficked into the United States." Moreover, in its 2021 World Drug Report, the United Nations Office on Drugs and Crime (UNODC) found that, "the main source of illicitly manufactured fentanyl is China,” which is also “the primary source of precursors and chemicals used in the manufacture of fentanyl and its analogues."
The only way the U.S. can effectively crack down on this China exploitation is if it bans the sale of flavored disposable vapes within its borders.
